Haitian Interim Govt. sacks 5 out of 10 Supreme Court Justices in retaliation against Simeus candidacy inclusion

Haitian interim Leaders sack 5 Supreme Court Justices in obvious retaliation against Simeus candidacy inclusion!

This is a protest against the annihilation of the right to political participation in Haiti again!!!

The Haitian Supreme Court has created a precedent in ruling 2 times for the inclusion and
the right for the political participation of Mr. Simeus in the upcoming presidential elections.
This ruling represents a public acknowledgement and recognition of the right to political participation of the over 1 million Haitian nationals living abroad, who represents
over US$ 1 billion for Haiti annually. More than the Haitian national budget itself.
Why not allow the Haitian people to choose their leader in Haiti and in the Diaspora?
The role of the Supreme Court is generally to interpret, enforce and amend the law. The Haitian Constitution states in ARTICLE 11: Any person born of a Haitian father or Haitian mother who are themselves native-born Haitians and have never renounced their nationality possesses Haitian nationality at the time of birth.
Mr. Simeus contends that he never renounced his Haitian nationality. The Haitian Supreme Court agreed and ruled in his favor. Thus, Mr. Simeus may campaign and run for president!
Only, the CEP or Haitian Electoral Counsel backed by the interim govt. has decreed
Against Mr. Simeus’ participation in the presidential race by fair or foul means!
We are acutely aware that the constitution is not the issue here. But rather the assurance of remaining in power indirectly and protecting the status quo. For the interim Govt. has shown little interest in implementing projects or policies not in line with its own personal benefits.
This interim government has gone beyond its mandate and powers and allowed the Haitian electoral consul or CEP which is neither an executive, legislative nor judiciary branch
of govt. direct power and legal precedence over the Highest Court of the land.
The question is why and for the benefit of whom this constitutional interpretation? Why this sudden specific case from a govt. which consistently demonstrates distinct disregard, and is even now in violation of the constitution.
We know that had Mr. Simeus like many others, remained in Haiti, he would not have
been able to acquire the education and success he has a achieved due to the systematic disadvantage assigned at birth to 90% of Haitians living in Haiti.
The firing of the 5 Supreme Court Justices immediately following their ruling to allow Mr. Dumarsais Simeus his chance as a presidential hopeful is in obvious retaliation against Supreme Court legal decision. This is outrageous and should not stand. This sudden conscientious awakening is suspect and easily recognized as political strong arm tactics and intimidation.
The focus should be on effective means of fighting corruption and drugs, developing economic growth, advancement and opportunity for all Haitians living in Haiti.
The continued politics of exclusion will only draw Haiti further from desperately needed constructive policies and reforms in the social, environmental and political realms.

Collage of opinions from the internet.

No pun intended: Is the CEP itself violating TWO articles of the constitution by holding elections on Jan 8th and a 2nd tour on Feb 8th?
> Why/how can the CEP violate two articles and then decide what other articles can not be violated?
> ARTICLE 134-1: The term of the President is five (5) years. This term begins and ends on the February 7 following the date of the elections.
> > ARTICLE 134-2: Presidential election shall take place the last Sunday of November in the fifth year of the President's term.

Small and Minor Point: One can assume that Haiti is the only country in the world that does not honor its Supreme Court decisions? Whether one agrees with decreed decisions or not.
The CEP holds greater power than the Highest Court of the land? This is sad and most disturbing. The CEP cannot be allowed to override the Supreme Court!!!! 2 times.
> This seems especially ironic as the reason given for disqualifying Simeus in the first place was that it was illegal and against constitutional law .
> One can assume it is a given in Haiti that the law is to be applied randomly and at convenience? Lawful Order is to remain nonexistent.
These Obvious Discrepancies demonstrate a lack of integrity , fair play and righteousness on the part of the interim govt..
Haiti has simply decided at/from the highest levels to disregard Supreme Court decisions - due to the fact that the powers in place disagree with said decisions. This is outrageous and Shameful!

Haiti has again proven to be shortsighted! The ripple affect of such a decision will not encourage trust or money from potential investors [foreign and Haitians living abroad] badly needed to help Haitian economic recovery.
Haitians continue a dedicated and reckless merry-go-round, a vicious circle of its own doing. Note: The Diaspora of the 50's and the 60's now have children and grandchildren strongly integrated into societal structures in the countries of their birth - who have less and less ties to Haiti due to a vast array of events: one example is the lack of security in Haiti which prevents the traditional visits and vacations - which in turn increases the disconnect to the Motherland.
> The continuous exodus of the middle and educated classes as whole families have immigrated abroad which will eventually translate into less money being sent to Haiti, less loyalty, understanding and tolerance for the realities facing Haiti by an upcoming generation with minimal patience, memories and sentiment for Haiti.
> With nearly US$ 1 billion annually from abroad heavily counted upon by Haitians living in Haiti, the above means less direct financial aid for Haiti over time.

Should Haiti continue down this road we foresee no political or economic changes for Haiti. Rather a rapid downfall already in full swing: begging for piece meals and scraps from the International Communities to feed its people, the disappearance of its middle class with continued exodus towards the US and Canada, or any country who will take them, a non-existent environmental and educational system, the stagnation of commerce preventing economic growth and social advancement; And most importantly continued govt. theft and illicit drugs deals for economic and social sustenance.

On Thursday 23 December, Prime Minister Gerard Latortue came to the defence of his cousin Youri Latortue [other reports have referred to Youri as the prime minister's nephew], who was blacklisted this week in an article in the French newspaper Le Figaro.
The head of government said that this attack is a roundabout way of getting at him in view of his integrity. Mr Latortue said that national and especially foreign sectors are behind this campaign. Mr Latortue, who said he does not take the Le Figaro article seriously, invites anyone who was reportedly a victim of his cousin's attitude to tell him.
With regard to the 20,000 euros paid to Youri Latortue every month for taking care of the Office of the Prime Minister's Intelligence Service, the prime minister stressed that no-one knows how much foreign embassies in the country pay for information. Then he added that several key ministries ought to have their own budget for that.
For his part, in a denial, Youri Latortue laid down to anyone "a challenge to prove my involvement in any case whatsoever of [taking a] percentage and corruption".
An article by Thierry Oberle in Le Figaro on 21 December portrayed Youri Latortue as the interim government's strongman. In an article entitled "Drug traffickers help themselves to Haiti", the journalist said that "at a lower level, the virtuous Gerard Latortue must, for his part, face his critics. He is blamed for retaining in his entourage his nephew, Youri Latortue, a person nicknamed 'Mister 30 Per Cent' because of the percentage he demands in return for favours. Worried, not without reason, about his own security, the prime minister pays 20,000 euros a month
