This is a features article on the various lawsuits under way under NAFTA and includes an interview from trade lawyer Howard Mann. The article is in two parts, the second part examining the decision-making process of tribunals under the WTO.

Imagine if the laws a country decided upon and enforced could be overturned by three people. This is what has happened under the North American Free Trade Agreement (NAFTA).
In Canada we have legislation that prohibits clear drinks from containing caffeine but in the United States, no such rule exists. However, under Chapter 11 of NAFTA, the company that makes Mountain Dew could technically sue the Canadian government today if it argued that our legislation was a “barrier of trade
