Havana, Aug 9 (Prensa Latina) "Nothing justifies that the Cuban five antiterrorist fighters remain unlawfully in US jails for impeding criminal actions against their own nation," lawyer Roberto Gonzalez affirmed in an interview Granma daily published Wednesday.
A year after the Eleventh Circuit Court of Appeals in Atlanta unanimously annulled the rigged trial that condemned them in Miami and reversed their sentences, the Five are still in prison.
Lawyer Roberto Gonzalez Sehwerert, brother of Rene, one of the Cuban Five, said they are hostages of a hostile policy against the island.
He explained the Prosecutor General´s office decided to request to the 12 magistrates of the Court to check the sentence passed on August 9, 2005.
For the Cuban lawyer, there is no legal justification for delaying the new verdict because the judges are analyzing what is obvious.
"They are discussing neither the charges of murder conspiracy and spying nor the bad application of the Classified Information Procedures Act, which are the essences of the issue," he stressed.
Concerning whether the 12 lawyers rule against the Defense, Gonzalez affirmed they would request the Atlanta Court to pronounce on the issues not included in the debates of that panel.
"We are witnessing a judicial machinery to perpetuate an imprisonment with political aims, and all the proceeding applied since September 1998 are a barrage of hatred, pressure and blackmail against five people representing the courage and rebelliousness of Cuba," he concluded.
