Canadian Lawyer Seeks Injunction To Prevent Erection Of Barriers - FTTA

Marc Tremblay, lawyer from Montreal, filed an application in Quebec Superior Court March 20,2001for an injunction to prevent interference with peaceful demonstration against the Summit of the Americas meeting April 20, 21,22 in Quebec city.

Lawyer seeks Injunction to prevent barriers to FTAA demonstrations

Marc Tremblay, lawyer from Montreal, filed an application in Quebec Superior Court March 20,2001for an injunction to prevent interference with peaceful demonstration against the Summit of the Americas meeting April 20, 21,22 in Quebec city.

He invokes Canada's charter of Rights and Freedoms S. 6.2 which guarantees mobility of Canadians, S. 2 which guarantees freedom of thought, belief, opinion and expression, freedom of the press and other means of communication, and freedom of peaceful gatherings; and especially S 7 and 11 which guarantee the presumption of innocence.

Marc Tremblay asks for temporary and permanent injunctions that;

1.No barriers be erected around the perimeter of the area where the Summit will be held in Quebec city;
2. Immediate cessation of the construction of the barrier;
3. No interference with demonstrations of Marc Tremblay in the space where the Summit will happen, and especially in front of the Centre of the Congress of Quebec (le centre des congres de Quebec.
4. Order that the governments of Canada, the Province of Quebec, the city of Quebec, and the police to permit Marc Tremblay to enter and demonstrate within public places inside the perimeter areas and to circulate freely and without restraint there for the duration of the Summit.

The application is set for hearing Thursday March 22 in the Superior Court of Quebec in the Palais de Justice de Quebec at 300 Boulevard Jean-Lesage, Quebec city, Room 3.14 at 9: 15 .A.M.

The Federal Government has asked Marc Tremblay to delay his application one week to give them more time to file a reply. The Court will decide on Thursday March 22 if the Government can have more time to reply.

It is very important that full support be given to Marc Tremblay in his efforts which are in the interest of all Canadians. If you live in the areas, it is very important that you attend the Court on Thursday March 22 and any other day the matter is before the court. Please be there.
